These Terms & Conditions ("Terms") form a binding agreement between you (and, where applicable, the business you represent) and StreakoAI, a product of Streak Monkey ("StreakoAI," "we," "us," or "our"), governing your access to and use of streakoai.com and our products and services, including StreakoBot and any other current or future StreakoAI product (together, the "Services"). By creating an account, installing a StreakoAI script or widget, or otherwise accessing or using the Services, you agree to be bound by these Terms. If you don't agree, don't use the Services. If you're accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" refers to that entity.
StreakoAI builds AI products and custom automation for businesses. Our flagship live product, StreakoBot, is an AI-powered support chatbot that businesses embed on their own websites via a short script tag; it answers visitor questions using a knowledge base the customer provides or that we help configure. Additional products (including StreakoVoice, StreakoRev, StreakoMed, and StreakoWats) may be offered from time to time and, once made available, are also governed by these Terms unless we present separate terms for them. We may also deliver bespoke automation agents or custom software under a separate statement of work, which will incorporate these Terms by reference unless expressly stated otherwise.
We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your own internal business purposes, subject to these Terms and any usage limits tied to your plan. We may add, change, or discontinue features of the Services at any time, and we'll use reasonable efforts to give advance notice of changes that materially reduce functionality you're actively paying for.
To use certain Services you may need to provide account details such as a name, business name, email address, and phone number. You're responsible for keeping this information accurate and for safeguarding any credentials, API keys, or embed keys issued to you — activity under your account is treated as authorized by you. You must be at least 18 years old and able to form a binding contract to use the Services.
Paid plans are billed in advance on a recurring basis (typically monthly, or as otherwise agreed in writing) and renew automatically until cancelled. Usage limits (such as conversation volume, seats, or connected properties) are described on our pricing page or in your order form and may change with reasonable notice ahead of your next renewal. Fees are exclusive of applicable taxes, which you're responsible for unless we're required by law to collect them. Except where required by law or expressly agreed by us in writing, fees already paid are non-refundable, including for partial billing periods.
We may offer a free trial or evaluation period for certain Services. We can modify or end a trial offer at any time. You may cancel a paid subscription at any time from your account settings or by contacting us; cancellation takes effect at the end of the current billing period, and you'll retain access to paid features until then. We don't provide prorated refunds for early cancellation unless required by law.

"Customer Content" means the knowledge base documents, conversation logs, configuration data, and any other content or data you or your website visitors submit to the Services. As between you and us, you retain all ownership rights in your Customer Content. You grant StreakoAI a limited, worldwide license to host, process, transmit, and display Customer Content solely as needed to provide, maintain, secure, and improve the Services for you. You're responsible for having the rights necessary to submit your Customer Content and for its accuracy and legality.
The Services use artificial intelligence and machine learning models to generate responses, summaries, and other output ("AI Output"). AI Output is generated automatically and may occasionally be inaccurate, incomplete, or unsuitable for a particular purpose. You're responsible for reviewing AI Output before relying on it for decisions that are business-critical, safety-related, legal, medical, or financial in nature, and for making sure it's appropriate before it reaches your end customers. We don't guarantee that AI Output will be error-free or uninterrupted.
Some Services connect to or rely on third-party platforms — for example, messaging platforms such as WhatsApp Business (via Meta), hosting and infrastructure providers, and underlying AI model providers. Where a Service connects to a third-party account you control, you're responsible for having the right to make that connection and for complying with that third party's own terms and policies alongside ours. We're not responsible for the availability, security, or content of third-party platforms, and we may suspend a connection or integration that we reasonably believe violates a third party's policies or puts the Services at risk.
StreakoAI and its licensors retain all right, title, and interest in and to the Services, including our software, models, branding, trademarks, and documentation. Nothing in these Terms transfers any of our intellectual property to you, other than the limited right to use the Services as set out above. Feedback you voluntarily give us about the Services may be used by us without restriction or obligation to you.
Each party may have access to non-public information of the other party in connection with the Services ("Confidential Information"). Each party agrees to use the other's Confidential Information only to perform its obligations or exercise its rights under these Terms, and to protect it using at least the same degree of care it uses for its own confidential information of similar importance, but no less than reasonable care. This section doesn't apply to information that's independently developed, rightfully received from a third party, or required to be disclosed by law.
The Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We don't warrant that the Services will be uninterrupted, error-free, or fully secure.
To the maximum extent permitted by law, StreakoAI and its officers, employees, and affiliates won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid us for the Services in the twelve (12) months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless StreakoAI and its officers, employees, and affiliates from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Customer Content, your use of the Services in violation of these Terms, or your violation of any applicable law or third-party right.
These Terms remain in effect for as long as you use the Services. We may suspend or terminate your access if you materially breach these Terms and don't cure the breach within a reasonable period after notice (or immediately, for serious violations such as illegal use or a security risk to the Services or other customers). Upon termination, your right to use the Services ends, though sections of these Terms that by their nature should survive (including intellectual property, confidentiality, disclaimers, limitation of liability, and indemnification) will continue to apply.
These Terms are governed by applicable law in the jurisdiction where StreakoAI is established, without regard to conflict-of-law principles, unless a mandatory local law provides otherwise. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. These Terms, together with any order form or statement of work, make up the entire agreement between you and StreakoAI regarding the Services and supersede any prior agreements on the same subject. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. We may update these Terms from time to time; if we make a material change, we'll update the "Last updated" date above and, where appropriate, notify active customers directly. Continued use of the Services after an update means you accept the revised Terms.
